Construction Site Injury Lawyers in Colorado Springs
Claims against contractors, property owners, and equipment makers other than your employer when a construction site injury was their fault.
We don’t handle workers’ compensation claims. If you were hurt at work, your workers’ compensation claim against your employer is separate, and you should pursue it with a workers’ compensation lawyer. This page is about a different claim: against someone other than your employer whose negligence caused the injury, or about injuries to people who weren’t working on the site at all.
Why a third-party claim matters
In Colorado, workers’ compensation is the exclusive remedy against your employer and your co-workers. It pays medical care and part of your lost wages, but not pain and suffering or your full losses. A claim against a negligent third party is an ordinary injury claim and can recover everything an injury claim can.
If workers’ compensation has paid benefits, the comp insurer has a right to be repaid from a third-party recovery. That lien affects the net result and has to be negotiated as part of the case.
Who a third party might be
- A general contractor or subcontractor other than your employer, responsible for the part of the site or the work that caused the injury.
- The property owner or developer, where it controlled the conditions.
- The manufacturer of a defective ladder, scaffold, power tool, or machine.
- A driver who struck you in a work zone or while you were driving for work.
- An engineering or safety firm that designed or inspected the work.
One limit matters here: a general contractor can be treated as your statutory employer and share your employer’s immunity. Whether that applies depends on the contracts and on who did what, and it’s one of the first questions in any construction claim.
Injuries to people who weren’t working
Pedestrians hit by falling debris, drivers and cyclists hurt by unsafe work zones, and neighbors whose property is damaged have ordinary negligence and premises claims against the contractors and owners, and workers’ compensation rules don’t limit them.
Common construction injuries
Falls from ladders, scaffolds, and roofs; being struck by falling objects or equipment; trench collapses; electrocution; and caught-in or crushing injuries from machinery cause most serious construction injuries. Many involve safety standards that set a clear measure of what should have been done.
How we handle construction claims
We work alongside your workers’ compensation lawyer, get the contracts that show who controlled the work, the incident and safety records, and any inspection reports, preserve the equipment involved, and identify every party whose negligence contributed.
